Terms of Service

These Terms of Service ("Terms") govern your use of Equilibrium (the "Service"), a web-based decision-making workspace. The Service is provided by skybye2.0 ("we", "us", "our"). By accessing or continuing to use the Service, you are entering into an agreement with skybye2.0 and agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Equilibrium helps you compare options, weigh trade-offs and track your confidence in personal and professional decisions. It is offered on paid monthly subscription plans with a free trial period.

2. Eligibility and accounts

You must be of legal age to form a binding contract, or have authority to bind the organisation you represent. You agree to provide accurate information, keep your login credentials confidential, and you are responsible for activity under your account.

3. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose or in violation of any applicable law;
• engage in fraud, spam, or impersonation;
• infringe the intellectual property or other rights of anyone;
• interfere with the security or operation of the Service, including introducing malware, probing or testing vulnerabilities, or scraping;
• reverse engineer, resell, redistribute, or circumvent technical limits of the Service.

4. Intellectual property

skybye2.0 retains all rights, title and interest in the Service and its intellectual property, including software, documentation, design and branding. We grant you a limited, non-exclusive, non-transferable licence to use the Service within your selected plan. You keep ownership of the content you enter, and grant us a limited licence to host and process it solely to provide the Service.

5. Payments, subscriptions and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, renewal, taxes, cancellation and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew monthly until cancelled. See also our Refund Policy.

6. Service availability

We work hard to keep the Service running well, but we do not guarantee that it will be uninterrupted, timely, secure or error-free. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. No professional advice

Equilibrium is a tool to help you organise your thinking. It does not provide financial, legal, career, medical or other professional advice. Decisions you make remain your own responsibility.

8. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, pose a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time. On termination, we may delete your data after a reasonable period.

9. Limitation of liability

To the extent permitted by law, skybye2.0 will not be liable for indirect, consequential or special damages, including loss of profits, data or goodwill, and our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing in these Terms limits liability for fraud, death or personal injury where such limitation is not permitted by law.

10. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
